“US Warns Nigerians: Visa Overstay Now Leads to Permanent Ban and Criminal Charges”

It further warned that consular officers have full access to an individual’s immigration history and will be aware of any past violations.
“There is no such thing as an ‘honest mistake’—it is your responsibility to use your visa correctly,” the statement added.
Strict Enforcement of Immigration Laws
U.S. immigration laws have undergone significant changes, especially during Donald Trump’s presidency (2017–2021), which introduced stricter enforcement measures. Many of these policies continued under subsequent administrations.
During Trump’s first term, the “zero tolerance” policy led to the prosecution of all illegal border crossings and resulted in family separations. His administration also imposed the Travel Ban, commonly referred to as the “Muslim Ban,” which restricted entry from several predominantly Muslim countries, including Nigeria. Although this ban was later lifted by President Joe Biden in 2021, immigration enforcement remained stringent.
In 2019, Trump’s administration introduced tougher public charge rules, making it more difficult for immigrants who relied on government assistance to obtain green cards.
Amid the COVID-19 pandemic in 2020, his administration also implemented Title 42, a policy that allowed for the rapid expulsion of migrants at the border without asylum hearings.
Continued Enforcement Under Trump’s Second Term
Although President Biden reversed or modified some of these policies during his time in office, visa overstay penalties have remained strict. Now, with Trump back in power, his administration has doubled down on immigration enforcement, reinforcing the consequences of overstaying a visa.
