BREAKING: Court Throws Out Case Seeking Removal of David Mark, Aregbesola as ADC Leaders

A Federal High Court in Abuja has dismissed a lawsuit seeking the removal of former Senate President David Mark and former Osun State governor Rauf Aregbesola from their positions as National Chairman and National Secretary of the African Democratic Congress (ADC).

Delivering judgment on Friday, Justice Joyce Abdulmalik of the Federal High Court ruled that the matter concerns the internal affairs of a political party, an area where courts lack jurisdiction.

The judge explained that political parties operate as voluntary associations, meaning membership and leadership positions are based on free choice rather than legal compulsion.

According to the court, individuals dissatisfied with decisions within their political parties should resolve such disputes through the party’s internal mechanisms rather than seeking judicial intervention.

Justice Abdulmalik further noted that disputes related to party membership, leadership selection, or internal management are generally not justiciable, and therefore cannot be adjudicated by the courts.

She advised aggrieved members to either pursue internal party remedies or, if dissatisfied, exercise their freedom to exit the party and join another political platform.

The ruling effectively puts an end to the legal challenge seeking to remove the ADC’s national leadership.
